Agreement to Terms

These Terms of Service govern services by Absolutely Clean LLC (dba "Absolutely Clean Pressure Washing by Stew"), operated by Stew Esposito in North Carolina's Triangle Area.

By booking services, accessing the website, or engaging otherwise, you agree to these Terms. If you disagree with any part of these terms, you should not use our services.

1. Services Offered

Absolutely Clean LLC provides professional exterior cleaning including:

  • House and porch washing (soft wash method)
  • Roof cleaning (PWNA certified methods)
  • Concrete and driveway cleaning
  • Deck and patio restoration
  • Gutter cleaning
  • Window cleaning
  • Holiday lighting installation and removal
  • Commercial property cleaning

Service Standards

All services use:

  • Eco-friendly, biodegradable cleaning solutions
  • Industry-standard equipment and techniques
  • PWNA certified methods
  • Appropriate pressure levels for each surface type

2. Booking & Scheduling

Estimate Process

Free, no-obligation estimates provided for all services. Estimates remain valid for 30 days.

Scheduling

  • Services scheduled Monday through Saturday during business hours
  • Appointment confirmation via phone, text, or email
  • Arrival window provided in advance
  • Punctuality sought but not guaranteed due to weather and job variables

Customer Responsibilities

Customers agree to:

  • Ensure clear access to all service areas
  • Remove or secure outdoor furniture, decorations, and personal items
  • Close all windows and doors
  • Disclose specific concerns or problem areas
  • Ensure water access availability

3. Pricing & Payment Terms

Pricing

  • Prices quoted based on assessed work scope
  • Additional charges may apply for excessive buildup, staining, or undiscovered conditions
  • Company obtains approval before exceeding original quote

Payment Methods

  • Cash
  • Check (payable to Absolutely Clean LLC)
  • Credit/Debit cards
  • Online payment via invoice

Payment Terms

  • Residential services: Payment due upon completion
  • Commercial services: Net 30 available with approved credit
  • Late payments subject to 1.5% monthly interest charge
  • Returned check fee: $35

4. Cancellation & Rescheduling Policy

24-Hour Notice Required

For cancellation or rescheduling without charge, provide at least 24 hours notice.

  • Less than 24 hours notice: $50 service charge may apply
  • No-shows: 50% of quoted price charged
  • Weather-related cancellations: Fee exempt

5. Liability, Insurance & Limitations

Insurance Coverage

Absolutely Clean LLC maintains comprehensive general liability insurance protecting both the company and customers.

Limitation of Liability

The company cannot be held liable for:

  • Pre-existing damage or defects not visible or disclosed beforehand
  • Damage to improperly installed or maintained surfaces
  • Paint failure on surfaces with poor adhesion
  • Damage to items not removed from work area
  • Oxidation or fading revealed after cleaning
  • Damage from customer's failure to disclose relevant information

Maximum Liability

Our maximum liability for any claim shall not exceed the total amount paid for the specific service causing the claim.

Property inspection is recommended within 48 hours post-service with immediate concern reporting.

6. 100% Satisfaction Guarantee

Our Promise to You

We stand behind our work with a 100% satisfaction guarantee. If you're not completely satisfied with our service, we will:

  • Return to address your concerns at no additional charge
  • Re-clean areas that don't meet our quality standards
  • Work until you are completely satisfied

Guarantee Conditions

  • Issues must be reported within 7 days of service completion
  • Applies to workmanship, not results beyond company control
  • Does not cover weather damage after service
  • Customer must allow reasonable opportunity for re-service

7. Property Access & Security

Access Requirements

  • Customer does not need to be present during service
  • Access needed to all service areas and water sources
  • Gates should be unlocked or access codes provided
  • Pets should be secured indoors or away from work areas

Property Security

  • Company secures gates and access points upon completion
  • Team is background-checked and professionally trained
  • Strict customer information confidentiality maintained

8. Weather Policy

Service Conditions

Services may be rescheduled due to:

  • Heavy rain or thunderstorms
  • High winds exceeding 25 mph
  • Freezing temperatures below 35°F
  • Ice or snow conditions

Weather Rescheduling

  • No charges for weather-related rescheduling
  • Company contacts customer immediately for rescheduling
  • Priority scheduling for weather-delayed services

9. Communications & Marketing

Service Communications

By providing contact information, you consent to receiving:

  • Service confirmations and reminders
  • Scheduling updates and changes
  • Follow-up quality checks
  • Important service information

Marketing Communications

With explicit consent, the company may send:

  • Seasonal service reminders
  • Special offers and promotions
  • Service tips and maintenance advice

SMS Messaging Terms & Compliance

This SMS messaging program is operated by Absolutely Clean LLC and complies with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.

Program Description

This messaging program sends appointment confirmations, reminders, scheduling updates, and customer support communications to customers who have explicitly opted in to receive SMS notifications. Opt-in is collected via our website contact form at absolutelycleanbystew.com with a dedicated checkbox for SMS consent.

Cancellation Instructions

You can cancel the SMS service at any time. Simply text STOP to the same number that sent you messages. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially through our website, and we will resume sending SMS messages to you.

Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message & Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. Consent is not a condition of purchase. For questions about your text plan or data plan, contact your wireless provider.

Supported Carriers

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.

Age Restriction

You must be 18 years or older to participate in our SMS program.

Privacy Policy

Mobile Information Protection

  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes
  • Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services
  • Information may be disclosed to subcontractors providing support services such as customer service, solely to fulfill your service request

Opt-Out: You may opt out of SMS at any time by replying STOP to any text message. You may opt out of email communications by clicking unsubscribe, or contact us directly.

10. Dispute Resolution

Resolution Process

  1. Contact us directly
  2. Work in good faith to resolve
  3. Mediation if needed
  4. Legal action as last resort

Governing Law

These terms are governed by North Carolina law. Any legal action must occur in Wake County courts.

11. Intellectual Property

All website content — text, graphics, logos, and images — belongs to Absolutely Clean LLC and is protected by copyright laws.

Photo Usage

  • Company may photograph work for portfolio and marketing
  • Customer property addresses won't be disclosed without permission
  • Customers may request no photo usage

12. Indemnification

You agree to indemnify, defend, and hold harmless Absolutely Clean LLC, its owner, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your breach of these Terms of Service
  • Your failure to provide accurate property or contact information
  • Your failure to disclose pre-existing property damage or hazardous conditions
  • Any third-party claims related to your property that are not caused by our negligence

13. Force Majeure

Absolutely Clean LLC shall not be liable for any delay or failure to perform services due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, hurricanes, floods, or earthquakes
  • Pandemics or public health emergencies
  • Government orders, restrictions, or regulations
  • Supply chain disruptions or equipment shortages
  • Utility failures or water restrictions

In such events, we will work with you to reschedule services at the earliest available opportunity at no additional cost.

14. Eligibility

By agreeing to these Terms of Service and booking services, you represent and warrant that:

  • You are at least 18 years of age
  • You are legally capable of entering into a binding contract
  • You are the property owner or have authorization from the property owner to request services

15. Severability & No Waiver

Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

No Waiver

The failure of Absolutely Clean LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of a provision must be in writing and shall not be deemed a waiver of any subsequent breach.

16. Modifications to Terms

Absolutely Clean LLC reserves the right to modify these terms at any time. Changes take effect immediately upon posting. Continued use of our services after any changes constitutes acceptance of the updated terms.
